What a will actually does
A will is a legal document that sets out exactly how your assets are distributed after you die. Without one, the law decides for you, and it may not choose the people you would have chosen.
Generic will kits don't know your situation. They don't account for blended families, business ownership, tax implications, children with disabilities, or assets that need careful handling. A poorly drafted will is far more likely to be contested which means your assets could end up with someone you never intended.
Why a lawyer and not a DIY kit?
A few things DIY kits commonly miss:Separation without divorce
If you're married but separated and living with a new partner, the law still recognises your spouse as entitled to part of your estate. Your new partner could miss out entirely.
Superannuation
Super isn't automatically part of your estate, it doesn't go to your family just because you've died. To make sure it goes to the right people, you need a Binding Death Benefit Nomination. Most DIY kits don't mention this, let alone help you do it properly.
